These Terms of Use ("Terms") govern your use of the Fuel Dock mobile app ("the App"), developed by Rainfall Software ("we", "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

Description of the App

Fuel Dock is a free companion app for boaters that lets you log trips and fuel fills, view usage statistics, and locate nearby marine fuel docks on a map. Trip and fuel fill data you enter is stored locally on your device.

License to Use

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, for your own personal, non-commercial use, subject to these Terms.

Fuel Dock Data — Not for Navigation

The App displays information about marine fuel docks — including location, hours, fuel types, and contact details — compiled from third-party and publicly available sources. This information may be incomplete, outdated, or inaccurate, and fuel dock operating hours, fuel availability, and services can change without notice.

The App is provided for general reference only and is not a substitute for official nautical charts, tide and weather information, or prudent seamanship. Always verify fuel dock availability directly (e.g. by phone) before relying on it, and use official navigational tools and your own judgment when operating a vessel.

Acceptable Use

You agree not to misuse the App, including by attempting to interfere with its normal operation, reverse-engineer it beyond what's permitted by applicable law, or use it in any way that violates applicable laws or regulations.

No Warranty

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of inaccuracies.

Limitation of Liability

To the fullest extent permitted by law, Rainfall Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or property, arising out of or related to your use of (or inability to use) the App, including reliance on any fuel dock information it displays.

Intellectual Property

The App, including its name, logo, design, and content (excluding data entered by you and third-party fuel dock data), is owned by Rainfall Software and is protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the App except as expressly permitted by these Terms.

Your Data

Trip and fuel fill logs you create in the App belong to you. See our Privacy Policy for details on how information is collected, used, and stored.

Changes to the App or These Terms

We may update the App or these Terms from time to time. Changes to these Terms will be posted on this page with an updated "Last updated" date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

Termination

You may stop using the App at any time by uninstalling it. We may suspend or discontinue the App, in whole or in part, at any time.

Governing Law

These Terms are governed by applicable law in the jurisdiction in which you reside, without regard to conflict-of-law principles, to the extent such law applies.
